THE REQUIREMENTS FOR A CHANGE OF NAME

The regulations for a change of name vary between surnames and given names.

Change of surname

For a change of surname, one of the following reasons must apply:

  • The applicant’s present name sounds ridiculous or offensive.
  • The applicant’s present name is hard to pronounce or write.
  • The applicant is of foreign extraction and would like to have a name that facilitates integration in Austria.
    • Such an application must be made within two years of acquisition of Austrian nationality.
  • The applicant would like to have a surname that he/she has hitherto used in good faith.
  • The applicant would like to have a surname that he/she was formerly entitled to use.
  • The applicant’s given name, surname and date of birth are identical with those of another person and there is a risk of confusion.
  • The applicant wishes to have a surname that he/she could have obtained by taking a step in law relating to names which is subject to a time limit but which he/she failed to take through no or only minor fault of her/his own, or the applicant has or wishes to have a double name in accordance with Art. 93 para. 2 Civil Code (ABGB) and would like to use a married surname without the addition of his/her previous surname.
  • The applicant wishes to have asurname that is identical with that of his/her registered partner and makes the application together with the establishment of the civil partnership. The application can also include the non-derivable ad personam right to combine the new surname with his/her current surname.
  • The applicant wishes to have the surname of his/her parents or of one of his/her parents or of some other person from whom his/her surname is derived and whose surname has been changed or is the subject of an application for change.
  • An applicant who is still a minor wishes to have the surname of the person who has custody or is caring for him/her on more than a short-term basis.
  • The applicant can present credible reasons why the change of surname is necessary to avoid an unreasonable economic or social disadvantage in cases where the disadvantage cannot be avoided by other means.
  • The applicant wishes to have a different surname for some other legally valid reason.

Change of given name
 

For a change of given name, one of the following reasons must apply:

  • The applicant’s present name is hard to pronounce or write.
  • The applicant is of foreign extraction and would like to have a name that facilitates integration in Austria.
    • Such an application must be made within two years of acquisition of Austrian nationality.
  • The applicant would like to have a given name that he/she has hitherto used in good faith.
  • The applicant would like to have a given name that he/she was formerly entitled to use.
  • The applicant’s given name, surname and date of birth are identical with those of another person and there is a risk of confusion.
  • The applicant can present credible reasons why the change of given name is necessary to avoid an unreasonable economic or social disadvantage in cases where the disadvantage cannot be avoided by other means.
  • The applicant wishes to have a different surname for some other legally valid reason.
  • An adopted child who is still a minor is to be given a different name or names than that or those given at birth.
    • Such an application must be made within two years of adoption or acquisition of Austrian nationality.
  • The applicant has changed his/her religious confession and wishes to have a given name that is typical of his/her new religious community or wishes to discard a given name that is typical of his/her previous religious community.
    • Such an application must be made within two years of the change of confession.
  • The applicant’s current given name does not correspond to his/her gender.
